A domestic dispute over the video game Fortnite escalated into a fatal shooting Wednesday night when 43-year-old Kelly Agar Garcia allegedly shot and killed his adult stepson, Azareel Martinez, 26, according to Davenport Police.
The incident unfolded at a residence in the Citrus Landing community, where Garcia lived with his wife, Adriane Daza, and her children—Martinez and two minors, ages 9 and 11.
Police say the conflict began when the 9-year-old was caught playing Fortnite, a game banned by the parents. Garcia reportedly confiscated the child’s cellphone, prompting the boy to retrieve a Smith & Wesson 9mm handgun from a bedroom nightstand.
Garcia managed to take the firearm from the child, but Martinez entered the room as tensions flared. After seeing the child in distress, Martinez spoke up against his stepfather, sparking a confrontation that turned violent.
Authorities allege Garcia shot Martinez multiple times in the chest and stomach, and then twice more in the back as Martinez attempted to flee. The young man collapsed and later died at a local hospital.

He is currently being held at the Polk County Jail. If convicted of second-degree murder, Garcia could face life in prison.
The Polk County Sheriff’s Office assisted with forensics at what was described as an “extensive” crime scene. Officials have not said whether the firearm was legally owned or if additional charges may be forthcoming.
Davenport is a city located about 30 miles southwest of Orlando.
